Who needs flat registration, and when

When you buy a flat, the sale deed is registered at the Sub-Registrar office. Registration of the sale deed is what records the transfer in government records. Most buyers register after the builder hands over possession of the flat.

If you are buying in an under-construction project, there is an earlier step. Under the Real Estate (Regulation and Development) Act, 2016, the builder cannot take more than 10% of the flat cost as advance or application fee without first signing a written Agreement for Sale with you (Section 13, as explained in the Odisha RERA FAQs). Ask the builder whether the agreement for sale will be registered, and keep a signed copy.

Time limit: a signed deed should be presented for registration within four months of the date of signing. After that, it can be accepted only with permission and a penalty, so do not delay.

Documents needed

IGR Odisha lists these documents for registration. Keep originals and photocopies ready:

  • True copy of the deed to be registered (sale deed or agreement)
  • All ownership papers of the property (for a flat, ask the builder for these)
  • Valid photo ID of buyer, seller and identifier: Voter ID, Aadhaar, Driving Licence, Passport or PAN
  • 3 passport-size colour photos of each buyer and seller
  • PAN card copy of buyer and seller if the deed value is more than ₹10 lakh (or Form 60 if there is no PAN)
  • Encumbrance Certificate (EC) for the property
  • Declaration in Form B (used when a house or building stands on the property)
  • Registered Power of Attorney and the attorney’s photo ID, if someone signs for the builder or owner

Step-by-step: how to register a flat in Odisha

Part A: Online on IGR Odisha

  1. Go to igrodisha.gov.in and open e-Registration (Online Submission of Deed). Create a user ID and password.
  2. Choose Document Submission, then New Application. Pick the deed type (sale deed).
  3. Enter the seller (first party), buyer (second party), identifier and witness details, and the property details. The portal calculates the stamp duty and registration fee for you.
  4. Check the declarations, choose up to 3 preferred dates for presenting the deed, and submit. You can also apply for the online EC here.
  5. The Sub-Registrar checks your draft. When it is approved, you get an SMS. Then pay the stamp duty, registration fee and EC fee online through the Odisha Treasury payment gateway and save the receipt.
  6. Book an online slot at the Sub-Registrar office. IGR charges a fixed ₹300 for a new slot. A booked slot cannot be cancelled. New slots open daily, so check early in the morning if none are free.

Part B: At the Sub-Registrar office

  1. Reach the office on your slot date and time with all original documents and IDs.
  2. Pay the small user fee at the office.
  3. The operator takes the fingerprints (biometrics), photo and digital signature of the buyer, seller, identifier and any consenter.
  4. The Sub-Registrar checks and approves the deed, prints the endorsement and signs it. The deed is scanned and saved.

Part C: Get your registered deed

You get the registered deed back from the office. You can also download a copy from the IGR portal through Track Application Status; an SMS with the download link comes to your mobile. For a certified copy later, apply on the same portal. See our guide: how to download a registered sale deed copy in Odisha.

Some small fixed charges are added, such as a deed postal fee of ₹60 (up to 25 pages) or ₹80 (more than 25 pages). The exact total depends on the value of your flat and the office. Before you pay, check it in the Registration and Stamp Duty Calculator and the Benchmark Valuation page.

Stamp duty can be paid by non-judicial stamp paper, franking or e-stamping.

Check the project on Odisha RERA before buying

Before you pay any advance, check that the project is registered with the Odisha Real Estate Regulatory Authority (ORERA):

  • Open rera.odisha.gov.in and go to Projects, then Online Registered Projects.
  • Select your district and find the project by name.
  • Check that the registration is valid. ORERA also lists projects with expired registration and revoked projects; be careful with these.
  • Match the promoter name and project details with what the builder told you.
  • You can also use the official ORERA mobile app.

Under RERA, the builder is responsible for structural defects for 5 years from handing over possession. If the builder breaks the rules, you can file a complaint on the ORERA website.

After registration

  • IGR sends the deed details (Form-3) to the Tahasil office so the land record can be updated through e-Mutation. You can see the transfer under Form3 Transfer Details on the IGR site. If mutation is stuck, read our guide on land mutation pending in Odisha.
  • Also update your name with the municipal body and utility providers.

Common mistakes to avoid

  • Paying more than 10% to the builder without a written Agreement for Sale
  • Not checking the project’s RERA registration and validity
  • Missing the four-month window after signing the deed
  • Booking a slot on the wrong date. A booked slot cannot be cancelled
  • Forgetting PAN copies (deed above ₹10 lakh) or the Encumbrance Certificate
  • Trusting middlemen with fees. Pay only through the official portal or treasury
